I sent a form-letter to the owners of all the Majordomo hosted mailing
lists at FLORA.org.
One of the replies received so far noted about the FLORA.org Terms and
Conditions:
Reminds me of the ones for BIX, and Noise Level Zero:
http://www.nlzero.com/agreement.shtml Seems reasonable.

Subject: Message to Owner of flora-admin-help@flora.org mailing list
You are receiving this message as the list manager for the
flora-admin-help@flora.org mailing list.
I have some house-cleaning items I wish all list managers to be aware of.
1) I am wanting to check to see if I have a currently correct email
address for all the list managers. Some lists were created some time ago,
and it is possible that the people have gone onward since that time. I
want to clean up any unused mailing lists, keeping only the live lists
online.
Please let me know if you wish to keep the list mentioned above running,
or if you prefer to close it down.
2) As an option to the Majordomo software, we are investigating the
MailMan package at http://www.flora.org/mailman/ . We are just
investigating at this time, which means that documentation is not fully
available for list managers. If you have questions, or offers to help
with documentation, please send them to the FLORA.org helpdesk
http://www.flora.org/flora/help/
3) The nature of the Internet has changed quite a bit since FLORA.org
was founded sometime around 1995.
<http://www.flora.org/flora/help/flora-admin-help/all?subject=Age+of+FLORA>
At that time people posted messages freely to websites and mailing
lists, and nobody really needed to worry about lawsuits.
Times have changed. In order to help legally protect the existence of
FLORA.org, and to clarify the non-commercial nature of FLORA.org, a new
legal document (and accompanying FAQ answers) are being drafted. The
current draft of the legal document is at:
http://www.flora.org/flora/legal.shtml
(Note: This is a legal document, not written in laypersons terms)
The existence of, and the wording of, a "FLORA.org Terms and Conditions"
has been quite controversial with some in the flora-admin-help@flora.org
mailing list. Those wishing to have input into this process, and to also
hopefully help me in creating FAQ answers to clarify the agreement, should
join the FLORA admin help forum http://www.flora.org/flora/help/
Some time in the future all LIST managers will need to confirm their
(and their list membership) acceptance of such an agreement. Lists where
such consensus cannot be reached would need to either be closed, or at a
minimum have any past archives removed. There would need to be the
understanding that any new submissions to FLORA.org mailing lists would be
under the new terms and conditions.
Any help in this is appreciated. The current discussions (and
misconceptions) have been very time consuming. While I am forced in the
current legal climate of the Internet to create such a legal document, it
would go a long way to helping FLORA.org remain sustainable if other
people were helping me create this documentation. FLORA.org is not a
one-way project, and needs help from volunteers to run.
Note: If there is any confusion, it needs to be clarified that this is a
"FLORA.org Terms and Conditions" and it only applies to FLORA.org websites
and mailing lists. My business hosts mailing lists and websites
commercially, and I also sponsor some websites, but these terms and
conditions *only* apply to FLORA.org Community WEB.
Thank you.
